Terms & Conditions

Welcome to ASCANx ("Platform", "we", "our", "us"). These Terms & Conditions ("Terms") govern your use of our website, mobile application, and services. By accessing or using ASCANx, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.

1. Definitions

• "ASCANx" refers to the platform, company, and its services.
• "User" refers to any person accessing or using the Platform.
• "Tenant" refers to a User who books properties or beds through the Platform.
• "Owner" refers to a User who lists properties on the Platform.
• "Admin" refers to ASCANx employees or authorized personnel.
• "Property" refers to any accommodation listed on the Platform.
• "Digital Twin" refers to an individual bed unit within a hostel or shared accommodation.
• "Booking" refers to a reservation made by a Tenant for a Property or Digital Twin.
• "Platform Fee" refers to the service charge paid to ASCANx (15% of booking amount).

2. Eligibility

To use ASCANx, you must:

• Be at least 18 years of age
• Have legal capacity to enter into binding contracts
• Provide accurate, complete, and current information
• Not be prohibited from using our services under applicable laws
• Have a valid CNIC (for Pakistani users) or passport (for international users)

3. Account Registration

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing valid CNIC or identity verification when requested

ASCANx reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.

4. User Roles and Responsibilities

4.1 Tenants

As a Tenant, you agree to:

• Provide accurate information when making bookings
• Pay the full amount due for your booking (rent + security deposit)
• Comply with property rules and local laws during your stay
• Not cause damage to the property or disturb other residents
• Check-out on time and return keys/access cards
• Submit valid CNIC and police verification documents when requested

4.2 Owners

As an Owner, you agree to:

• Provide accurate and truthful property information
• Maintain the property in habitable condition
• Honor confirmed bookings without cancellations (except emergencies)
• Respond to tenant inquiries within 24 hours
• Comply with all applicable property laws and tax regulations
• Complete property verification process before receiving premium benefits
• Pay platform fees as described in Section 8

5. Bookings and Payments

5.1 Booking Process

• Tenants submit booking requests through the Platform
• Bookings are confirmed only after payment is processed
• Owners cannot cancel confirmed bookings without valid reason
• ASCANx reserves the right to cancel bookings for fraud or policy violations

5.2 Payment Terms

• All payments are processed through PayFast (Raast, Cards, Mobile Wallets)
• Tenants pay: Monthly rent + Security deposit (10% of one month's rent)
• Platform fee: 15% of total booking amount (deducted from owner payout)
• Premium verification fee: As displayed at time of purchase (non-refundable)
• All prices are in Pakistani Rupees (PKR) inclusive of applicable taxes

5.3 Security Deposit

• Security deposit is held by ASCANx during the tenancy period
• Deposit is refundable within 14 days after move-out (minus any damages)
• Owners must provide damage evidence within 7 days of move-out
• Unresolved disputes are subject to ASCANx mediation

6. Cancellations and Refunds

6.1 Tenant Cancellations

• Cancellation 7+ days before move-in: 100% refund (minus PKR 500 processing fee)
• Cancellation 3-7 days before move-in: 50% refund
• Cancellation less than 3 days before move-in: No refund
• No refunds after move-in (except as provided in Section 6.3)

6.2 Owner Cancellations

If an owner cancels a confirmed booking:

• Full refund to tenant including platform fees
• Owner pays penalty equal to 30% of booking amount
• Repeated cancellations may result in account suspension

6.3 Property Issues

If the property is uninhabitable or significantly misrepresented:

• Tenant must notify ASCANx within 24 hours of check-in
• ASCANx will investigate and may offer relocation or full refund
• Owner may be liable for penalties and delisting

7. Property Verification

• Properties must undergo verification before premium benefits are unlocked
• Free verification: Basic document check (7-14 days)
• Premium verification: On-site or virtual inspection, verified badge (PKR 50-500)
• Verification validity: 12 months (requires re-verification thereafter)
• Falsified documents or misrepresentation results in permanent ban

8. Fees and Payouts

8.1 Platform Fees

• Booking platform fee: 15% of total booking amount
• Premium verification fee: As displayed (100% to ASCANx)
• CNIC verification fee: PKR 100 (if applicable)
• Payment gateway charges: Borne by ASCANx (not passed to users)

8.2 Owner Payouts

• Payouts processed monthly (after tenant payment confirmation)
• Payment methods: Bank transfer, Easypaisa, JazzCash
• Processing time: 3-5 business days after month end
• Minimum payout amount: PKR 5,000
• Owners must provide valid payment information

9. Prohibited Conduct

You may not:

• Use the Platform for any illegal purpose
• Post false, misleading, or fraudulent listings
• Circumvent ASCANx payment systems (e.g., direct payments outside Platform)
• Harass, threaten, or abuse other users
• Damage, hack, or interfere with Platform operations
• Create multiple accounts or impersonate others
• Share login credentials with unauthorized persons
• Use automated bots or scrapers without permission

10. Digital Twin (Bed) Specific Terms

• Each bed is individually tracked and assigned to one tenant at a time
• Check-in/check-out must be confirmed via Platform
• Tenants are responsible for their assigned bed and surroundings
• Owners must maintain bed hygiene and working amenities
• Beds marked "available" must be ready for immediate move-in
• Twin codes are non-transferable without ASCANx approval

11. Intellectual Property

All content on ASCANx, including logos, designs, text, graphics, software, and trademarks, are owned by ASCANx or its licensors. You may not copy, modify, distribute, or create derivative works without written permission.

12. Limitation of Liability

To the maximum extent permitted by law:

• ASCANx is not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 3 months
• We do not guarantee continuous, error-free, or secure Platform access
• We are not responsible for user conduct or property conditions

13. Indemnification

You agree to indemnify and hold ASCANx, its officers, employees, and agents harmless from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or violation of any third-party rights.

14. Termination

ASCANx may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Inactivity for 12+ months

Upon termination, you lose access to your account and any pending bookings may be cancelled. Outstanding payments will be settled per these Terms.

15. Dispute Resolution and Arbitration

• Governing Law: Laws of Pakistan (State Bank of Pakistan regulations, SECP, PECA)
• Jurisdiction: Courts in Lahore, Pakistan have exclusive jurisdiction
• Informal Resolution: Contact us at ceo@ascanx.com before legal action
• Arbitration: Disputes under PKR 500,000 may be resolved through binding arbitration (Pakistan Arbitration Act, 1940)
• Class Action Waiver: You agree to resolve disputes individually, not as a class action

16. Modifications to Terms

We may update these Terms periodically. Material changes will be notified via email or Platform notification. Continued use after changes constitutes acceptance.

17. Force Majeure

ASCANx is not liable for delays or failures caused by natural disasters, war, terrorism, strikes, government actions, internet outages, or other events beyond reasonable control.

18. Entire Agreement

These Terms constitute the entire agreement between you and ASCANx, superseding any prior agreements. If any provision is unenforceable, the remaining provisions remain in effect.
